1. Acceptance of terms

By purchasing, downloading, installing, or using any product from EKAITRADING (a trade name of TSDC CORPORACION S.R.L), you agree to these Terms of Service in their entirety. If you do not agree with any part, you must not use our products.

2. Service description

EKAITRADING develops and markets algorithmic trading software: automated strategies and indicators for NinjaTrader 8, and Expert Advisors (EAs) for MetaTrader 5. Our products are technical analysis and execution tools—they do not constitute financial advice, investment recommendations, or capital management of any kind (see Legal Notice, section 3).

3. Eligibility

To purchase and use our products, you must:

Be of legal age according to the laws of your country of residence.
Have the legal capacity to trade in financial markets.
Possess the corresponding platform licenses (NinjaTrader 8 or MetaTrader 5) and, where applicable, an active account with a broker or funding firm authorized to trade the relevant instruments.

4. License of use

EKAITRADING products are licensed, not sold. Source code and intellectual property remain the property of TSDC CORPORACION S.R.L at all times.
The license granted is personal, non-exclusive, and non-transferable to third parties, covering the use of the product according to the purchased tier (quarterly, semi-annual, annual, or lifetime, depending on the product).
Each license is activated via a unique hardware fingerprint (NinjaTrader) or account number (MetaTrader 5). The number of included activations and transfers is governed by the terms specified at the time of purchase for each product.
It is prohibited to: redistribute, resell, sublicense, decompile, reverse engineer, or share the source code or compiled files of any product with unauthorized third parties.
Failure to comply with this section entitles EKAITRADING to revoke... ...the non-refundable license.

5. Payments, billing, and refunds

Prices are displayed in the store at the time of purchase and are subject to change without prior notice for future purchases (this does not affect licenses already acquired).
The refund policy is governed by the Returns and Refunds Policy document: a full refund is available within the first 48 hours after purchase; no refunds are issued after that period.

6. Updates and support

Active licenses receive updates released for the corresponding product during the license's validity period.
Technical support is provided in Spanish via the channel indicated in the store's Contact section.

7. Acceptable use

You agree not to use our products for:

Illegal activities under the laws applicable in your jurisdiction.
Market manipulation or any practice prohibited by your broker, clearinghouse, or relevant regulator.
Any purpose other than the analysis and execution of trading operations for which the product was designed.

8. Limitation of liability

Our products are provided "as is." We do not guarantee trading results, profitability, or the total absence of software errors.
EKAITRADING and TSDC CORPORACION LTDA are not liable for capital losses, lost profits, or indirect damages arising from the use of our products.
The user is solely responsible for their trading decisions, the risk configuration of each product, and testing any strategy on a demo account before trading with real capital.

9. Intellectual property

All code, documentation, trademarks, logos, and content belonging to EKAITRADING are the property of TSDC CORPORACION S.R.L. Nothing in these Terms transfers such ownership to the license purchaser.

10. Modifications to these terms

We may update these Terms of Service at any time. Changes apply to future purchases; for licenses already acquired, the conditions in effect at the time of purchase remain valid, unless applicable law requires otherwise.

11. Termination

We may suspend or revoke access to a product, without a refund, in the event of a breach of these Terms (including unauthorized redistribution or fraudulent use of the license).

12. Governing Law and Jurisdiction

As TSDC CORPORACION S.R.L. operates from Costa Rica, Costa Rican law applies to dispute resolution mechanisms (whether through the courts, arbitration, etc.).
